Orchard Files

Terms of service

Last updated 12 March 2026. These terms apply to every workspace.

1. The service

We provide managed file storage, synchronisation and versioned history as described on this site. We may change how the service works; where a change removes something you rely on, we give 30 days' notice by email.

2. Your account

You are responsible for the API keys you issue and for the people you add to a workspace. Tell us promptly if a key is exposed and we will revoke it. We will never ask you for a password or a secret key, by email or otherwise.

3. Billing

Plans are billed monthly in advance; add-ons and overage in arrears. Invoices are issued on the first of the month and are due within 14 days. You may cancel at any time and the service runs to the end of the paid period — we do not refund partial months, and we do not charge a cancellation fee.

4. Acceptable use

Do not use a workspace to store or distribute material that is unlawful where you or we operate, to distribute malware, or to send unsolicited bulk mail using links we host. Do not attempt to reach another tenant's data or to degrade the service for others. We will suspend a workspace for these, and we will tell you why.

5. Availability

We target 99.9% monthly availability of the storage endpoints and publish maintenance in advance where it is planned. If we miss the target in a given month, Orchard plans receive a credit of 10% of that month's fee for each full 0.1% below it, to a maximum of one month. Credits are requested by email and applied to the next invoice.

6. Your data

Your files remain yours. We claim no licence to them beyond what is needed to store, transfer and restore them at your direction. On termination you have 30 days to export, after which the data is destroyed.

7. Liability

We are liable for what the law says we cannot exclude. Beyond that, our total liability in any 12-month period is limited to the fees you paid in that period. We are not liable for indirect or consequential loss. This is why you should also keep a copy somewhere we do not control — durable storage is not a substitute for a backup you own.

8. Termination

Either of us may end the agreement with 30 days' notice. We may suspend immediately for non-payment after two written reminders, or for a breach of section 4. If we shut the service down entirely, you get 90 days' notice and no further charges.

9. Governing law

These terms are governed by the law of the jurisdiction in which Orchard Files is registered, and disputes go to its courts. Nothing here removes any consumer right you have where you live.
